SIERRA FOOTHILLS MUSIC TOGETHER Policies, Procedures, and Liability Waiver

Our teachers are excited to play with you in person. Our classes have some important safety requirements that we all must follow to stay safe. Below is our Policies and Procedures and a Liability Waiver. You are responsible to adhere to these policies and procedures. Clicking the agreement box and submitting a registration means that you have read and agreed to all written below, including our waiver of liability.

  • Each family will maintain social distance from other families as much as possible in our indoor spaces.
  • Each family will bring their own small percussion instruments, and scarves, and nothing will be shared from the teacher to the families or between the families.
  • We ask that no more than 3 adults come as part of a family, to limit the number of total people in our group.
  • Please bring your at home music kit to each class.
  • Please refrain from eating in class.
  • Please refrain from using your phone in class. We need every adult to stay present with the music and to be following the teacher’s example during class. Your attention on your child and the musical process is important!
  • Before you leave home: Please do a quick self-assessment and stay home if you or anyone living in your home is showing any one of these symptoms: fever, cough, runny nose, shortness of breath, difficulty breathing, other respiratory symptoms, chills, muscle pain, headache, sore throat or new loss of taste or smell. Also, please stay home if you or anyone you’ve been in close contact with has been exposed to COVID-19. In this case, you can request a pre-recorded class to make up for your missed class. If you or anyone in your household is diagnosed with COVID or you believe your symptoms are consistent with COVID, please let us know ASAP so we can communicate this with our families. You will remain anonymous, but this will be helpful in preventing any spread of the illness in our class.
  • If you or your child tests positive for Covid-19, and you believe your last attended class may have put others at risk for infection, please email us immediately. As a business, we will follow all local health district guidelines for any close contact exposures. If you test positive for Covid, due to the increased aerosols released during singing, we ask that you remain away from the studio for TEN days following the onset of symptoms or a positive test. If you have a close contact exposure, please mask for class until 5 days after your exposure and a negative antigen test. If your child is too young to mask and was a close contact exposure, please do not come to class until 5 days after exposure and a negative antigen test. We will have a no tolerance policy for any child or participating adult who comes to class showing symptoms of illness. If you are symptomatic, PLEASE STAY HOME and make up instead. When in doubt, please err on the side of caution out of respect for others in the class.

  • If you miss class, you may attend a different class as a makeup or you can request a pre-recorded class. There will be no refunds or credits offered for individual missed classes. 
  • If an individual class must be canceled for a reason that affects just one day, we will either hold that class via Zoom that day, at its usual time, or we will email a prerecorded class. You will be notified by text and email no later than 30 minutes before class starts if an outdoor session must be canceled and how we will hold class instead. 
  • In the event of natural disaster, prolonged inclement weather, or community crisis requiring the cancellation of our in-person class program, we will make every attempt to offer online classes, additional classes, semester extensions or reasonable alternatives. There will be no refunds offered if live classes need to be cancelled due to local community shutdowns/quarantines.
  • We cannot offer refunds or credits for classes that are cancelled for reasons beyond our control.
  • If a family becomes unable to attend for the majority of a semester due to becoming ill with COVID-19, a partial credit for remaining classes is possible with a doctor's note (required).
  • You are responsible for complying with these policies and procedures, and ensuring that any adult who brings your child has read and understood them. We reserve the right to modify or change our offerings and terms of service at any time without notice. We shall not be liable to you or any 3rd party for modifications, price change, suspension or discontinuation of service. We cannot offer credits or refunds.

WAIVER:

COVID-19 ASSUMPTION OF THE RISKS AND WAIVER OF LIABILITY
As a willing participant in Music Together®classes with Sierra Foothills Music Together, my family and I agree to the following:

ASSUMPTION OF THE RISKS:

I understand that naturally occurring disease processes (including, but not limited to, the novel coronavirus or COVID-19), may exist in the community, including at Sierra Foothills Music Together, and present an inherent risk that cannot be eliminated. I acknowledge that, although Sierra Foothills Music Together is taking reasonable measures to avoid contact, transmittal, and exposure of disease processes like COVID-19 between people in our classes (including Music Together teachers, and third parties), it is ultimately my own responsibility to ensure that I take appropriate actions to safeguard myself and my child/children. I understand and agree that as a registered family with Sierra Foothills Music Together, I am accepting and voluntarily assuming the risk that my child or I may be exposed and become ill as a result of COVID-19 and other diseases.

WAIVER OF LIABILITY:

I, on behalf of myself and my children, hereby voluntarily release, forever discharge, and covenant notto sue Sierra Foothills Music Together and its owners, managers, contractors, members, employees, agents, and volunteers, or the outdoor location owner (“Released Parties”) for any claims that may arise out of or relate in any way to my or my child’s exposure to any communicable disease, including but not limited to the novel coronavirus (COVID-19) or any other accident that may cause harm. The claims hereby released include, but are not limited to, claims of negligence against any of the Released Parties. I HAVE CAREFULLY READ THIS WAIVER AND FULLY UNDERSTAND ITS CONTENTS. BY ENROLLING IN CLASSES AT SIERRA FOOTHILLS MUSIC TOGETHER, I UNDERSTAND I HAVE GIVEN UP CERTAIN LEGAL RIGHTS AND THAT THIS IS A BINDING LEGAL DOCUMENT.
